With offices in Palm Springs, Rancho Mirage, El Centro, Victorville, and Banning, we offer opportunities to work in a fast-paced, high-achieving environment while being part of a firm that truly cares about its people.Applicants must reside in California.Duties include:Assist Attorney in the preparation of legal documents including, but not limited to government claims, complaints, motions, declarations, petitions, briefs, demands, case management statements, and other similar legal documents, as assigned.Assist Attorney to prepare, propound, and respond to written discovery, demands for defense medical exams, inspection demands, depositions, civil subpoenas, and other similar legal documents prior to the discovery cutoff deadline, as assigned.Assist Attorney in the preparation of all documents related to the designation of expert trial witnesses, the retention of expert witnesses, the management of expert witness file, coordinate expert depositions prior to the expert discovery cutoff deadline, as assigned.Assist Attorney to prepare trial related documents such as the statement of the case, witness statement, exhibit list, exhibit binders, motions in limine, coordinate trial testimony of fact witness and retained and non-retained expert trial witnesses, as assigned.Assist Attorney to calendar and manage all statute of limitations that are related to the client’s case, , as assigned.Assist Attorney to research and analyze statutes, regulations, legal articles, judicial decisions, and other legal sources, providing written analysis to attorneys.Assist Attorney to communicate with each client every thirty (30) days regarding the client’s injuries, medical diagnoses, ongoing symptoms, treatment status, the identity of all medical treatment providers. Update clients on the status of their case and any key dates.Assist Attorney to obtain, update, and finalize all subrogation liens, including but not limited to third party health insurance liens, Medi-Cal Liens, and Medicare liens.Assist Attorney to locate medical experts and authorize medical treatment, as needed.Assist Attorney to document all medical specials and perform Howell analysis.Assist Attorney to request all medical records and bills in a timely manner.Assist Attorney to request all loss of earnings documents in a timely manner.Assist Attorney to open and insurance claim, as necessary, and confirm insurance coverage.Assist Attorney to draft medical summaries for attorney review.Assist Attorney to draft settlement demands for attorney review.Assist Attorney to process settlement documents, including the release and settlement check, and manage disbursement process.Assist Attorney to maintain full compliance with the Health Insurance Portability and Accountability Act and confidential records.Assist Attorney to complete all training as assigned by the Director of Litigation Division – Operations.Assist Attorney to perform other paralegal and case management related duties as assigned by the handling attorney.Must be thoroughly familiar with the California Code of Civil Procedure and able to calculate legal deadlines for all documents served on client by the court, parties, and state, county, and city governments and agencies via personal service, overnight mail, mail, electronic service, and facsimile.Must be able to draft and execute a valid proof of service and serve legal documents on all parties.Must be able to file all legal documents with the Superior Court of California.Familiarity with the Federal Rules of Civil Procedure and ability to file legal documents with the U.S. District Court’s Public Access to Court Electronic Records (PACER) preferred.Familiarity with Medicare Set Aside, settlement planning/structured settlements, and Petition for Approval of Compromises of Claim or Action or Disposition of Proceeds of Judgment for Minor or Person with a Disability.Compliance with Business and Professions Code section 6450 (d) in the following manner: Every two years, commencing January 1, 2007, any person that is working as a paralegal shall be required to certify completion of four hours of mandatory continuing legal education in legal ethics and four hours of mandatory continuing legal education in either general law or in an area of specialized law. All continuing legal education courses shall meet the requirements of Section 6070. Certification of these continuing education requirements shall be made with the paralegal’s supervising attorney. Capture all client injuries, ongoing symptoms, and treating providers. Update clients on the status of their case and any key dates. Document communication in Smart Advocate using note topic Client Contact.c.      Communicate with all non-treating clients via phone, video conference, or in-person every 30 days, using the non-treating client contact template. Keep clients informed of the status of their case and any key milestones. Document communication in Smart Advocate using note topic Client Contact.d.     Keep in mind that you are always an advocate for the client, always doing what is in the best interest of the client and their claim.File Management:a.      Conduct initial review of the file to determine any key missing information prior to the first call to the client.b.     On the initial call, confirm treatment status with the client. Note all providers in Smart Advocate. All file reviews to use the File Review template and be saved in Smart Advocate using the note topic: File Review.m.   Completion of medical summary, chronology, and/or Howell number calculation, on files as directed by Attorney.n.     Timely review of all medical records and billing.o.     Timely submit detailed demands to the Attorney for review and approval.p.     All written settlement offers are conveyed to the client in a timely manner in writing. All offers are recorded in SmartAdvocate in real-time.q.     Monitor case expenses and client medical bill amounts, ensuring that medical and case expenses are under one-third of known policy limits. If medical bills exceed one-third of known policy limits, plan to send a Policy Limit demand.r.      Case Managers with no Assistant Case Manager are responsible for requesting client healthcare plan verbiage.     What We Are Looking For...
    Ideally, 3+ years’ experience in Workers’ Compensation
    Trial Experience is a plus.
    Requirements
    Currently admitted to a State Bar (good standing) or pending Bar results

    Responsibilities
    Perform Initial Case Evaluation & Develop Case Strategy
    Manage & handle a caseload of 150 – 250 workers’ compensation cases in a profitable manner.
    Analyzing records and reports.
    Ability to assign, delegate & oversee appropriate tasks, duties, and work product of paralegals, case managers, legal assistants, and/or other office staff assigned to assist the attorney with the handling of the caseload.
    Ability to conduct effective discovery to procure the evidence necessary for successful litigation
    Ability to understand and evaluate medical records & medical legal reports, synthesize them under American Medical Association Guides to Permanent Disability 5th Edition criteria, to determine appropriate case value and draft settlement demands
    Ability to negotiate settlements and make appropriate recommendations to the client regarding all legal issues involved with or affected by their workers’ compensation matterAbility to make effective appearances on behalf of the client at depositions, hearings, depositions of medical & vocational experts, trials, and appellate proceedings, and effectively litigate on the client’s behalf overall
    Strong legal writing and legal research skills with the ability to draft settlements, trial briefs, appellate briefs, petitions, letters & other legal documents.
    Managing a docket of Workers' Compensation cases to resolution
    Excellent written & verbal communication skills and ability to communicate with all parties effectively & professionally.
    Deadline and detail-oriented
    Ability to prioritize and multitask.
