    GENERAL DESCRIPTION

    Applicants for this position should be prepared to pass an extensive background investigation, including a comprehensive criminal history, employment, education, financial status, reputation, and social media check. The OAG's Medicaid Fraud Control Unit works cases jointly with the FBI, HHS-OIG, and other federal law enforcement agencies. Applicants for this position will also be required to obtain a Top Secret federal security clearance in order to fully participate in DOJ Prosecutions as a Special United States Attorney (SAUSA). Since most security clearance problems arise from criminal records or unresolved bad credit issues, full criminal and credit checks will be run on all applicants prior to employment.

    This posting is for an Assistant Attorney General in the Texas Medicaid Fraud Control Unit, which will be cross-designated as a SAUSA, and serve as a Trial Attorney/Prosecutor for the National Rapid Response Strike Force in the Health Care Fraud Unit of the U.S. Department of Justice, Criminal Division, Fraud Section. The National Rapid Response Strike Force was created in 2020 with a mission to investigate and prosecute fraud cases involving major health care providers that operate in multiple jurisdictions, including major regional health care providers operating in the Strike Force cities, with a focus on investigations and prosecutions of individuals and corporate health care fraud. The National Rapid Response Strike Force coordinates with the Civil Division's Fraud Section and Consumer Protection Branch, U.S. Attorney's Offices across the country, state Medicaid Fraud Control Units, the FBI, HHS-OIG, and other agency partners in order to identify, investigate, and prosecute significant multi-jurisdictional and corporate health care fraud cases.

    This position will independently direct, conduct, and monitor investigations, prepare for and conduct trials, and advise on pleadings and other court filings. Upon accepting an offer of employment, applicants must make a three-year commitment to the Strike Force. This position will be located in Houston, with a prosecution region encompassing the State of Texas.

    Generally, as a Trial Attorney in the HCF Unit's National Rapid Response Strike Force, the position:

    • Handles the development and management of HCF prosecutions. Engages in all phases of investigation and litigation, including, but not limited to, the use of grand jury, advising federal law enforcement agents, preparing appropriate pleadings, litigating motions, and conducting trials in U.S. District Court;

    • Makes charging decisions and proposes dispositions with regard to assigned cases; and

    • In collaboration with Unit managers, develops and maintains the Section's program to foster effective national investigation and prosecution of HCF violations, including advising on strategy and legal complexities, and developing litigation priorities, policy, and legislative recommendations.

    The position will be supervised by the Deputy Chief over Prosecutions in the OAG MFCU Austin headquarters, but will be supervised day-to-day by the Department of Justice. In addition to HCF Unit training, MFCU will provide Medicaid Fraud training opportunities, including national training opportunities with the National Association of Medicaid Fraud Control Units, based on availability of resources. As a condition of grant funding, this position must engage only in HCF investigation and prosecution activities with a Texas Medicaid nexus.

    ESSENTIAL POSITION FUNCTIONS

    BRIEF POSITION SUMMARY

    Performs advanced (senior-level) project management work involving coordinating the planning and initiation of projects at various levels of completion; monitoring the progress and schedule of projects; and communicating with project stakeholders, management, and other relevant parties.     Manage, develop, and oversee projects using accepted project management methodologies. Coordinate project activities with other state agencies, governmental jurisdictions, or private sector partners and contractors.Monitor and manage project quality to ensure that project deliverables are acceptable and fulfill the terms of the project contract or specifications.Monitor and manage project schedule and cost to ensure that the project is completed within budget.Create documentation procedures to capture and manage changes in original project plan.     Qualifications:

    MINIMUM QUALIFICATIONS

    EDUCATION:

    Graduation from an accredited four-year college or university is required (substitution allowed).
    PREFERRED EDUCATION:

    Graduation from an accredited four-year college or university with major course work in engineering, construction management, architecture or a related field is preferred.
    SUBSTITUTION:

    Additional years of experience working in construction project management may substitute for required education on a year-per-year basis up to four (4) years.A master's degree in engineering, construction management, architecture, or a related field may substitute for two (2) years of the required experience.
    EXPERIENCE:

    Ten (10) years' experience in commercial construction management is required (substitution allowed).Experience using Microsoft Office (such as Outlook, Word, or Excel) is required.
    PREFERRED EXPERIENCE:

    Experience in ProjectMates project management software is preferred.Experience of state and federal purchasing or contracting procedures is preferred.Experience in military construction is preferred.Experience working in a military environment is preferred.
    REGISTRATION, CERTIFICATION OR LICENSURE:

    A valid license by the Texas Board of Architectural Examiners or registered as a Professional Engineer in the State of Texas is required. If not currently registered, must obtain registration within the first year of employment. Maintains professional license by attending required continuing education classes annually.

    PHYSICAL/WORKING CONDITIONS

    Work is typically performed in an office setting involving sitting, standing, walking, stooping, kneeling, or crawling. Directly address and effectively handle personnel issues, including hiring, separations, follow-through on disciplinary actions as needed, and employee performance rewards.     Qualifications:

    Minimum Qualifications

    Bachelor's Degree in Environmental Engineering, Environmental Science or a closely related field.Four (4) of experience as an Environmental Engineering Project Manager, Environmental Engineering Researcher, or closely related position in environmental science.Three (3) years of progressively responsible work experience managing projects and/or staff.Knowledge of local, state, and federal laws and regulations relevant to the team and Reginal Water Project Development Division (RWPD).Knowledge of the State of Texas required principles and practices of public administration and management.
    Preferred Qualifications

    Two years of experience with the review of engineering submissions as part of requests for financial assistance from TWDB.Experience in planning and/or design of water treatment, storage, and distribution systems or wastewater treatment plants and collection systems.Experience with water laws, federal and state programs and permitting.

    The Texas Office of the Attorney General's Medicaid Fraud Control Unit (MFCU) is seeking an experienced prosecuting attorney to serve as an Assistant Attorney General, who will be cross-designated as a Special Assistant United States Attorney (SAUSA) and detailed to the U.S. Attorney's Office for the Southern District of Texas (SDTX), Criminal Division, Fraud Section, in Houston.

    Although employed by the State of Texas, the attorney will function operationally as a federal prosecutor, performing the same duties and exercising the same prosecutorial authority as an Assistant United States Attorney in SDTX. This position exists to augment federal prosecutorial capacity in MFCU-developed prosecutions.

    Applicants for this position must be able to successfully complete an extensive state background investigation, including criminal history, employment, education, financial, reputation, and social media reviews. This position also requires obtaining a Top Secret federal security clearance to fully participate in federal prosecutions as a Special Assistant United States Attorney (SAUSA).

    The attorney will handle criminal health care fraud prosecutions and will:

    • Independently direct, conduct, and monitor criminal investigations;

    • Use grand jury processes; advise federal law enforcement agents; prepare indictments, informations, and other pleadings; litigate motions; and conduct trials in U.S. District Court;

    • Make charging recommendations and propose case dispositions for assigned matters;

    • Develop and manage a docket of health care fraud prosecutions, including complex and corporate cases; and

    • Coordinate closely with federal, state, and local partners involved in health care fraud enforcement.

    Cases handled in this position must include a Texas Medicaid nexus, as required by grant funding conditions. This requirement does not limit cases to Texas-only conduct and does not preclude prosecutions involving other federal health care programs (e.g., Medicare, TRICARE) or multi-jurisdictional matters, provided that Medicaid fraud is part of the case.

    Day-to-day supervision will be provided by the U.S. Attorney's Office for the Southern District of Texas, Criminal Division, Fraud Section, while administrative supervision and employment matters remain with the Texas Office of the Attorney General, with the attorney reporting to the MFCU's Deputy Chief of Prosecution. The attorney will be fully integrated into SDTX and managed in the same manner as other federal prosecutors, including the assignment of cases and litigation responsibilities. This position is physically located in Houston, Texas, with office space provided at both SDTX and the Houston MFCU office.

    Upon appointment, the attorney must commit to a minimum three-year term prosecuting health care fraud cases in this role. This commitment is intended to ensure continuity and effectiveness in complex prosecutions.

    The attorney will receive DOJ criminal prosecution training, Medicaid fraud-specific training, and opportunities to attend national training programs, subject to resource availability.

    Job Description:

    Performs complex (journey-level) project management work as part of the Enterprise Planning Office (EPO) Project Management team. Work involves coordinating the planning and initiation of projects at various levels of completion; monitoring the progress and schedule of projects; and communicating with project stakeholders, management, and other relevant parties. This position will have a specialized focus on government procurement projects for IT solutions. Works under general supervision, with moderate latitude for the use of initiative and independent judgment. Salary commensurate with experience.

    Essential Job Functions:

    Work with stakeholders to develop project budgets, schedules, work plans, resources requirements, and cost estimates and projections. Partners with OCA procurement manager to manage end-to-end procurement process for the customer, to include procurement planning, solicitation development, bid evaluation, and contract award. Works closely with procurement manager to ensure compliance with internal policies, regulatory requirements, and procurement best practices. Compiles and distributes project information and project status reports to agency staff and others.Develop evaluation criteria, scoring tools, and supporting documentation.Provides stakeholders with timely assessments and project performance. Coordinates project activities with other state agencies, governmental jurisdictions, or private sector partners and contractors. Monitors and manages project quality and costs to ensure that project deliverables are acceptable, fulfill the terms of the project contract or specifications, and are completed within budget.Assists in developing criteria for evaluating programs, proposals, and other pertinent information related to project assignments. Identifies potential project risks and difficulties and design strategies to mitigate or avoid them. Plan and manage efficient project meetings.

    Minimum Qualifications:

    Graduation from an accredited four-year college or university with major coursework in Project Management, business or public administration, or a related field.     Knowledge, Skills, and Abilities (KSAs):

    Knowledge of project management theories and practices applicable to highly complex projects; local, state, and federal laws and regulations relevant to the administration of the project undertaken, including the Quality Assurance Team (QAT)/Major Information Resources Project (MIRP) process; and state technology procurement processes and requirements. Skill in project management monitoring, in addressing changes in scope and budget, and in the use of a computer and applicable software. Ability to exercise sound judgment in making critical decisions, to analyze complex information and develop plans to address identified issues, to demonstrate negotiation and facilitation skills, to identify project risks, to prepare reports and charts, to communicate effectively and present information both orally and in writing to technical and non-technical audiences; and to assign duties and responsibilities and coordinate the work of project staff.
    Employment Conditions:

    Regular attendance required. Travel may be required. Operates standard office equipment, computer hardware and software. Must sit for extended periods of time. May require some lifting, up to 20 pounds. Valid Texas driver's license required to operate motor vehicle to conduct business.
